Stoned Crazy Terms of Service (Effective December 2025)

Welcome to Stoned Crazy! These Terms of Service ("Terms") govern your access to and use of our website, store, and all related features, content, and services (the "Services"). By accessing or using any part of the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our Services.

1. Eligibility & Account

You must be at least the age of majority in your jurisdiction to use our Services. You are responsible for maintaining the confidentiality of your account and all activities under your credentials. You may not transfer your account to others. We reserve the right to suspend or terminate your account for any violation of these Terms.

2. Products & Orders

We strive for accuracy in product descriptions, but color/appearance may vary by device. We reserve the right to limit, discontinue, or change products at any time. Orders are offers to purchase and are accepted at our discretion. Orders are subject to our Refund Policy.

3. Pricing & Payment

Prices, discounts, and promotions may change without notice. Prices at checkout apply. You agree to provide accurate, current payment and account info and to update it as needed. Taxes, shipping, and handling are additional unless stated otherwise.

4. Shipping & Delivery

We ship within the USA and Canada only. Delivery times are estimates, not guarantees. Risk of loss passes to you upon carrier handoff. We are not liable for carrier or customs delays or for packages lost or damaged in transit.

5. Returns, Refunds & Exchanges

Returns are accepted for defective, damaged, or incorrect items within 7 days of delivery. To request a return, contact us at Orders@stonedcrazy.shop with your order number, photos, and a description of the issue. We reserve the right to inspect and verify claims.

Approved refunds are issued to the original payment method; exchanges may be offered based on inventory. Items must be unused and in original packaging. Shipping costs are non-refundable except in cases of our error.

All sales are final on clearance or custom items.

6. Privacy & Data Protection

Your personal information is collected, used, and shared in accordance with our Privacy Policy. We use Shopify as our e-commerce provider, and your data may be processed by Shopify and its partners, potentially outside your country of residence. By using our Services, you consent to such transfers. We implement reasonable safeguards to protect your data but cannot guarantee absolute security. 7. Intellectual Property

All content, trademarks, and designs on the Services are owned by Stoned Crazy or its licensors. You may not use, reproduce, or distribute any content without written permission. All rights reserved.

8. Third-Party Tools & Links

We may provide access to third-party tools and links for your convenience. Use of such tools is at your own risk. We do not monitor, endorse, or control third-party content and disclaim all liability related to it.

9. Shopify Relationship

Our store is hosted on Shopify. All sales are directly between you and Stoned Crazy. Shopify is not responsible for any aspect of your transactions with us.

10. Feedback

By submitting feedback or reviews, you grant us a perpetual, worldwide, royalty-free license to use them for any purpose. You represent that you have the necessary rights to your feedback.

11. Prohibited Uses

You may not use the Services for unlawful purposes, to infringe on intellectual property, harass others, transmit malware, or violate any applicable law. We reserve the right to suspend or terminate accounts for violations.

12. Disclaimer of Warranties

The Services and products are provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted or error-free service. Some jurisdictions do not allow the exclusion of certain warranties; in such cases, our liability is limited to the maximum extent permitted by law.

To the fullest extent permitted by law, Stoned Crazy and its affiliates, officers, employees, or agents are not liable for indirect, incidental, consequential, or special damages (including lost profits, business interruption, or loss of data) arising from your use of the Services or products, even if advised of the possibility. Our total liability for any claim is limited to the amount paid by you for the product or service at issue.

You agree to indemnify and hold harmless Stoned Crazy, its affiliates, and employees from any claims, damages, or expenses (including attorneys’ fees) arising from your breach of these Terms, your use of the Services, or your violation of any law or third-party rights.

15. Dispute Resolution

Any disputes arising out of or relating to these Terms or your use of the Services will be resolved first through good-faith negotiations. If unresolved, disputes will be submitted to binding arbitration in Hennepin County, Minnesota, under the rules of the American Arbitration Association. You waive the right to participate in class actions. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in court for intellectual property or confidentiality breaches.

16. Governing Law

These Terms are governed by the laws of the State of Minnesota, USA. Any disputes will be resolved in the courts or arbitration forums of Hennepin County, Minnesota.

17. Changes to Terms

We may update these Terms at any time. Material changes will be posted on this page with the effective date. Continued use of the Services constitutes acceptance of changes.
